Terms of Service | Fancy Cafe AI

1. Welcome and Acceptance

These Terms of Service ("Terms") apply to Fancy Cafe AI at fancycafe.pro (the "Service"). By using the Service you agree to them. If you disagree, please do not use it.

2. What the Service Does

From 1 or 2 photos, Fancy Cafe AI generates a vertical 9:16 MP4 lasting approximately 15 seconds, in the style of the "Your First Time in a Fancy Cafe" meme. With 1 photo, a fictional person fills the second part. A reference clip of the trend guides timing, camera and movement. The template sound from the viral video is included by default, and Silent removes it. We do not own that sound and grant no rights to it, so commercial use needs your own clearance. People shown in your photos do not record any new audio. Every render costs credits and no free preview exists, so you will need a signed-in account and credits from a pack or a subscription. Completed clips are kept in My Creations.

Fancy Cafe AI is an independent fan-made AI tool, with no affiliation to TikTok, Instagram, CapCut, Know Your Meme or the creators of the original video. We use those names only to identify the cultural reference, and they do not signal a partnership, an official release or an endorsement. Outside AI video providers generate the clips and receive your photos for that purpose. Those providers, along with model names and abilities, may change. We are not affiliated with them unless we state otherwise.

Results may come out incomplete, strange or close to what another user received. Check every finished clip before relying on it, publishing it or passing it along.

3. Who Can Use the Service

• You must be at least 18 and legally able to enter this kind of agreement. When acting for an organization, you must have authority to commit it.
• Keep the billing and account information you give us correct and up to date.
• Protect your login, because you answer for whatever happens on your account.
• Email support@fancycafe.pro immediately if you suspect someone else got in.

4. Your Photos, Our Platform and Ownership

Any lawful rights you have in your uploads, and in clips produced from them, stay with you. It is your job to ensure that uploads and any later use comply with the law and with intellectual property, privacy, publicity and other rights. Use only pictures that are yours or that you may use. Minors, celebrities and other public figures must not be uploaded, and you must not pass off a generated clip as genuine footage of any real person. Please apply an AI-generated label wherever a network provides one.

So that we can generate, store and show your clips, you give Fancy Cafe AI and its vendors a limited, non-exclusive license to host, copy, transmit, process and display your photos and clips. This license is solely for operating, securing, troubleshooting and supporting the Service, and ownership of your lawful content does not move to us.

The software, interface, brand, documentation and original site text belong to Fancy Cafe AI or its licensors. Unless the law permits it or we have agreed in writing, do not copy, resell, reverse engineer, scrape or commercially exploit the Service.

5. Credits, Subscriptions, Payment, and Cancellation

• Payment authorization: Buying a pack or subscription lets the checkout processor charge the displayed price, any applicable taxes, and recurring fees that were shown to you beforehand.
• Credit packs and plans: A pack is a single purchase. Monthly and yearly subscriptions continue into a new period unless renewal is switched off, and the interval and price are shown before you pay.
• Credits in use: The credits a render consumes depend on your chosen options. Bought credits remain with the purchasing account and lapse on the schedule displayed on pricing or at checkout. Credits are returned automatically when a render fails or a safety filter stops it.
• Cancelling: Use the subscription portal or the cancellation control under pricing or account settings. This ends future renewals and normally applies from the end of the paid period you are in.
• Card data: Payment runs through the processor named at checkout, and card numbers do not get stored on our servers.
• Refunds: Eligibility and the request process appear in the Refund Policy. Consumer rights that cannot be waived are unaffected by these Terms.

If a charge seems wrong, contact support@fancycafe.pro before raising a payment dispute so that we have a chance to check it.

6. Prohibited Conduct

Treat this section as our acceptable-use policy. It covers each uploaded photo, each generated clip and each attempt to get around our safeguards.

You may not upload, request, create or help someone else create anything in these categories:

1. Sexual content: Pornography, nudity, explicit or sexually suggestive scenes, sexual services or fetish material. There are no exceptions to the ban on child sexual abuse material, sexualized depictions of minors, and the grooming or exploitation of children.
2. Violence and gore: Graphic injury, torture, the glorification of violence, terrorism or violent extremism, guidance on weapons of mass destruction, or anything meant to threaten or enable physical harm.
3. Hate and harassment: Attacking, dehumanizing or harassing people, or urging discrimination or violence against them, because of protected characteristics.
4. Impersonation and misleading content: Non-consensual intimate imagery, misleading portrayals of real people, impersonation, identity fraud, or synthetic media designed to fool viewers about where it came from or whether it is authentic. You may not use or animate someone's photo without their consent, and you may not upload celebrities or public figures.
5. Infringement and privacy violations: Material that breaches copyright, trademark, publicity or privacy rights, reveals confidential information, or violates other proprietary or personal rights.
6. Unlawful or harmful acts: Illegal content, scams, phishing, malware, promoting regulated wrongdoing, exploiting vulnerable people, or attempts to deceive or injure anyone.

Equally, do not evade safety filters, test or disturb security, automate access without our permission, collect outputs in bulk, resell access without approval, or use the Service in breach of the law or card-network rules.

7. Moderation, Reports, and Our Response

Automated checks run on uploaded photos and generated clips, using keyword blocklists, safety classifiers and moderation from model providers. Since automation makes mistakes, items that are flagged or reported may get further review.

To report banned content, suspected impersonation, a child-safety concern or an infringement, email support@fancycafe.pro with the subject Content Report. Give the URL or account details, explain the problem and attach any screenshots or evidence. We aim to acknowledge reports within three business days. Child-safety matters and credible risks of physical harm take priority.

Based on severity, past conduct and applicable law, we may decline a request, block or remove content, restrict features, suspend or close an account, retain records, or inform authorities of suspected illegal activity. Accounts tied to child exploitation, terrorism, credible threats, fraud or non-consensual intimate imagery can be suspended at once. To contest an enforcement decision, respond to the notice or send support the relevant context.

8. Privacy

Our Privacy Policy sets out how personal data is gathered, used, kept and shared. When you use the Service, you understand that your photo and request details may go to hosting, storage, safety and AI video providers where needed to make your clip.

9. Availability and Modifications

The Service comes as is and as available. Credit prices, feature limits and uptime may shift over time. We may alter, pause or withdraw parts of the Service to keep it secure, reliable, lawful or compatible with our providers. We make no promise of nonstop operation or of any specific outcome from a given photo.

10. Warranty Disclaimer

We give no express or implied warranties beyond what the law requires. That covers merchantability, fitness for a particular purpose, non-infringement and whether AI output is accurate. Nothing a model produces counts as legal, medical, financial or other professional advice.

11. Liability Limits

As far as the law allows, Fancy Cafe AI, its affiliates, vendors and staff bear no liability for indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, data, goodwill or business opportunities connected with the Service. Rights or liabilities that the law does not let us exclude remain in place.

12. Suspension and Ending Access

You are free to stop using the Service whenever you wish. We may restrict, suspend or terminate access if we reasonably suspect fraud, abuse, a security or legal issue, a payment problem or a policy risk. The Privacy Policy describes how account closure and personal data deletion requests work.

13. Revisions to the Terms

Changes to the Service, our providers or the law may lead us to revise these Terms. We will post the updated text on this page with a new date at the top, and where legally required we will also give extra notice of material changes. If you keep using the Service after a revision takes effect, you accept it.

14. Governing Law

The laws of the place where the operator of the Service is established apply to these Terms, without removing mandatory consumer protections you are entitled to. Please write to us first, so that we can try to settle the matter informally before any formal claim.
